"Legal Agreement" means that the terms of this agreement, once accepted by the User, are binding on the latter.<\/p>\n For simplicity, "User," "you," "your," and similar terms, whether singular or plural, refer to you, the User. "We," "our," and similar terms refer to the company that owns and operates Cacciatore d'uve. "Cacciatore d'uve" refers to this site. "Agreement" refers to this document, as amended from time to time. The Agreement is concluded in the Italian language. Additional definitions can be found in the "Definitions" section at the bottom of this Agreement.<\/p>\n To use Cacciatore d'Uve, you must carefully read and accept the Agreement by clicking the specific acceptance button. If you do not accept the Agreement, you will not be able to use the Service.<\/p>\n Registration, Grape Hunter content, and prohibited use<\/p>\n In order to use the Service or part of it, Users must register by providing, in a truthful and complete manner, all the data requested in the relevant registration form and<\/p>\n <\/p>\n fully accept the privacy policy and these terms and conditions. The User is responsible for safeguarding and maintaining the confidentiality of their login credentials.<\/p>\n It is understood that under no circumstances will the Owner be held responsible in the event of loss, disclosure, theft, or unauthorized use by third parties, for any reason whatsoever, of the Users' access credentials.<\/p>\n Registered Users may deactivate their accounts, request their deletion, or stop using the Service at any time, through the Cacciatore d'uve interface or by contacting the Owner directly.<\/p>\n The Owner, in the event of violation of these Terms, reserves the right to suspend or terminate the User's account at any time and without notice.<\/p>\n The Owner reserves the right to suspend or cancel the User's account at any time and without notice if it believes that:<\/p>\n Content available on Grape Hunter<\/p>\n The content available on Cacciatore d'uve is protected by copyright law and other international laws and treaties protecting intellectual property rights and, unless otherwise specified, its use is permitted to Users exclusively within the limits specified in this clause.<\/p>\n The Owner grants the User, for the entire duration of the Contract, a personal, non-transferable and non-exclusive license, for exclusively personal and never commercial purposes and limited to the device in use by the User for the use of such contents.<\/p>\n Therefore, the User is expressly prohibited from copying and\/or downloading and\/or sharing (except within the limits illustrated below), modifying, publishing, transmitting, selling, sublicensing, processing, transferring\/assigning to third parties or creating derivative works in any way from the content, including third-party content, available on Cacciatore d'uve, nor allowing third parties to do so through the User or his\/her device, even without his\/her knowledge.<\/p>\n Where expressly indicated on Cacciatore d'uve, the User, for personal use only, may be authorized to download and\/or copy and\/or share some content made available on Cacciatore d'uve, provided that all copyright notices and other notices provided by the Owner are faithfully reproduced.<\/p>\n The Owner does not moderate the content or links provided by third parties displayed on Cacciatore d'uve. The Owner is not responsible for such content or its accessibility.<\/p>\n <\/p>\n Users are responsible for their own content and that of third parties they share on Cacciatore d'uve, whether by uploading it, posting content, or otherwise. Users indemnify the Owner from any liability related to the unlawful dissemination of third-party content or unlawful use of Cacciatore d'uve.<\/p>\n The Owner does not moderate any content posted by the User or third parties, but undertakes to intervene in response to reports from Users or orders issued by public authorities regarding content deemed offensive or illegal.<\/p>\n In particular, the Owner may suspend or interrupt the display of content in the event that:<\/p>\n The only rights granted to the Owner in relation to the content provided by Users are those necessary for the operation and maintenance of Cacciatore d'uve.<\/p>\n Unless otherwise stated, by submitting, posting, or displaying content on or through Cacciatore d'uve, you grant the Owner and other Users a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any media or distribution method now known or later developed.<\/p>\n Users may use services or content included in Cacciatore d'uve provided by third parties, but must first read and accept the terms and conditions of those third parties. Under no circumstances will the Owner be held liable for the proper functioning or availability, or both, of services provided by third parties.<\/p>\n The Service must be used in accordance with the Terms. Users may not:<\/p>\n <\/p>\n Grape Hunter offers some subscriptions or paid services.<\/p>\n The fees, duration, and conditions of the accounts and paid services are indicated in the relevant section of Cacciatore d'uve.<\/p>\n Each order submitted constitutes an offer to purchase the products. Orders are subject to availability and the Owner's discretionary acceptance.<\/p>\n The User must select the products and complete the checkout process after carefully reviewing the information in the order summary. The order is placed upon confirmation and is subject to payment of the price, taxes, and shipping and payment costs indicated in the Order Summary form.<\/p>\n The Order Processing Receipt does not constitute acceptance of the order. The contract is concluded when the Owner sends the Order Confirmation to the email address provided by the User. The Owner reserves the right not to confirm an order by notifying the User within 5 business days of placing the order, using the email address associated with the purchase, of the unavailability of one or more of the purchased products. In this case, the Owner will refund the price and shipping costs incurred by the User.<\/p>\n Cacciatore d'Uve uses third-party tools for payment processing and does not in any way come into contact with payment information\u2014such as credit card information\u2014provided.<\/p>\n Any costs incurred for handling payments not accepted by the User will be charged to the User.<\/p>\n <\/p>\n All payments on Cacciatore d'Uve are completely secure. You can choose to pay in several ways:<\/p>\n <\/p>\n Credit card payments are free of charge and completely secure, as your card details are managed directly on the bank's website, even if you wish to save your card details for future purchases. You can pay with all Visa (including PostePay) and Mastercard credit cards.<\/p>\n If your payment fails, you can access your order in your account and change your payment method or repeat the payment.<\/p>\n At Cacciatore d'Uve, you can pay with Apple Pay, a quick and easy way to pay using cards saved in the Wallet app on your iPhone. Deliveries to smaller towns and islands take 2-4 business days. On the day of shipment, you will receive an email with tracking information.<\/p>\n For shipping, we use recyclable cardboard packaging, specifically designed for wines and spirits, certified and extremely durable. Breakage-resistant packaging is also included.<\/p>\n Shipping to Italy is free (except for gift vouchers, which are sent via email).<\/p>\n <\/p>\n Deliveries are made during normal business hours to the address indicated by the User and according to the methods specified in the order summary.<\/p>\n Upon delivery, the User must check the contents, specifying any anomalies on the delivery form.<\/p>\n In the event of failure to collect the Products within the time limit established by the carrier, the Products will be returned to the Owner, who will refund the price of the Products, but not the shipping costs. The Owner cannot be held responsible for delivery errors due to inaccuracies or incompleteness in completing the purchase order by the User, for any damage that may occur to the Products after delivery to the carrier, if the latter has been chosen and appointed by the User, or for delays in<\/p>\n <\/p>\n delivery to the latter attributable.<\/p>\n Important: If you receive a damaged or damaged package, please note this on the delivery note by signing "RESERVATION."<\/p>\n Please notify Cacciatore d'uve customer service of the incident immediately via the contact page.<\/p>\n attaching any photos of the damage, non-original packaging, etc.<\/p>\n Until full payment of the price of the products ordered, the products remain the property of the Owner.<\/p>\n Prices, descriptions, or availability of products displayed are subject to change without notice. However, the images and colors of the products offered for sale on Cacciatore d'uve may differ from the actual ones due to multiple factors, including, but not limited to, the User's device monitor, photographic filters, etc. Therefore, the User acknowledges and accepts that any such minor differences do not constitute a lack of conformity of the products.<\/p>\n The Order is fulfilled within the terms specified on the summary page and in the Order Confirmation email, subject to the availability of the ordered product.<\/p>\n The Owner cannot be held liable for damages suffered by the User due to delays in delivery that are not dependent on circumstances foreseeable by the parties at the time of sending the Order Confirmation.<\/p>\n If you purchase products or services on Cacciatore d'uve, you have the right to withdraw from the contract without stating a reason within 14 days. The withdrawal period expires 14 days after the day on which you or a third party\u2014other than the carrier and designated by you\u2014acquires physical possession of the goods. To exercise the right of withdrawal, you must inform the Owner of your decision to withdraw by sending an explicit statement to the contact details indicated.<\/p>\n To this end, you may use the withdrawal form provided in the "Definitions" section of this document. The User is also free to express their decision to withdraw from the contract in any other equivalent form.<\/p>\n If the User withdraws from this contract, all payments made to the Owner will be refunded, including delivery costs (with the exception of additional costs resulting from the possible choice of a type of delivery other than the least expensive type of standard delivery offered) without undue delay and in any case not<\/p>\n <\/p>\n After 14 days from the day the Owner is informed of the User's decision to withdraw from this contract. Such refunds will be made using the same payment method used by the User for the initial transaction, unless the User has expressly agreed otherwise; in any case, the User will not incur any fees as a result of such refund. The refund may be withheld until the goods are received or until the User has demonstrated that they have returned the goods, whichever is earlier.<\/p>\n The User is requested to return the goods and deliver them to the Owner without undue delay and in any case within 14 days from the day on which he communicated the withdrawal from this contract. The deadline is met if the User returns the goods before the 14-day period expires. The User is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.<\/p>\n The costs of returning the goods will be borne by the User.<\/p>\n Limitations on the right of withdrawal<\/p>\n Returned products that are damaged or used beyond what is strictly necessary to establish their nature, characteristics, and functioning will be refunded after deducting the decrease in value resulting from the damage or use. Refunds are excluded if the decrease in value is total.<\/p>\n The User is requested to include a copy of the delivery document received inside the package.<\/p>\n The right of withdrawal is in any case excluded in relation to:<\/p>\n If one of the above-mentioned exceptions applies to the goods purchased by the User, the latter will not be able to exercise the right of withdrawal.<\/p>\n The clauses regarding the exercise of the right of withdrawal, as well as the related consequences and exceptions, apply exclusively to Users who qualify as consumers, i.e., Users acting for purposes outside of their business or professional activity.<\/p>\n The User purchasing as a consumer has the right to a guarantee of conformity of the products and services purchased within 24 months of purchase, provided that notification is given within 2 months of their discovery.<\/p>\n To exercise the right of guarantee, the User is required to contact the Owner at the contact information contained in this document, providing an accurate description of the defect found.<\/p>\n If a lack of conformity of the product is ascertained, the User has the right to obtain, at his discretion, the repair or replacement of the product.<\/p>\n <\/p>\n The User also has the right to request from the Owner an appropriate price reduction or termination of the contract in the following cases:<\/p>\n The User is still required to return defective products.<\/p>\n The User undertakes to indemnify the Owner (as well as any companies controlled or affiliated by the same, its representatives, directors, agents, licensees, partners and employees), from any obligation or liability, including any legal costs incurred for legal defense, which may arise from damage caused to other Users or third parties, in relation to the content uploaded online, to the violation of the law or of the terms of these conditions of service.<\/p>\n Cacciatore d'Uve and all features accessible through Cacciatore d'Uve are made available to Users, under the terms and conditions set forth in the Agreement, without any warranty, express or implied, other than those required by law. Specifically, no warranty is provided regarding the suitability of the services offered for the User's specific purposes.<\/p>\n The use of Cacciatore d'Uve and the features accessible through Cacciatore d'Uve is carried out by Users at their own risk and under their own responsibility.<\/p>\n Specifically, the Owner, within the limits of applicable law, is liable for contractual and non-contractual damages to Users and third parties exclusively for intent or gross negligence when these are an immediate and direct consequence of Cacciatore d'uve's activities. Therefore, the Owner will not be liable for:<\/p>\n <\/p>\n To ensure Users get the best possible experience of the Service, the Owner reserves the right to interrupt the Service for system maintenance or update purposes, informing Users through constant updates on Cacciatore d'uve.<\/p>\n Users are not authorized to reproduce, duplicate, copy, sell, resell, or exploit any portion of Cacciatore d'uve and its Services without the prior written permission of the Owner, granted directly or through a specific resale program.<\/p>\n The Owner may tolerate forms of resale carried out on a personal (one-to-one) and limited basis; any form of mass resale is expressly excluded.<\/p>\n For information on the use of personal data, Users must refer to Cacciatore d'uve's privacy policy, which is considered part of these Terms.<\/p>\n All trademarks of the Application, figurative or nominal, and all other signs, trade names, service marks, word marks, illustrations, images, logos that appear relating to Cacciatore d'uve are and remain the exclusive property of the Owner or its licensors and are protected by applicable trademark laws and related international treaties.<\/p>\n All trademarks and other signs, trade names, service marks, word marks, illustrations, images, and logos relating to third parties, and the content published by such third parties on Cacciatore d'uve, are and remain the exclusive property of such third parties and their licensors and are protected by applicable trademark laws and related international treaties. The Owner does not own such intellectual property rights and may use them only within the limits and in accordance with the agreements entered into with such third parties and for the purposes set forth therein.<\/p>\n Users declare that they are of legal age according to the legislation applicable to them. Under no circumstances may anyone under the age of 13 use Cacciatore d'Uve.<\/p>\n Conditions for receiving deliveries<\/p>\n Furthermore, the User who makes the purchase through Cacciatore d'uve declares and guarantees that the person receiving the shipment of the purchased products is of legal age according to the legislation applicable to the latter.<\/p>\n The Owner reserves the right to make changes to the Terms at any time, giving notice to the User by publishing them within Cacciatore d'uve.<\/p>\n <\/p>\n Users who continue to use Cacciatore d'uve after the changes are published accept the new Terms without reservation.<\/p>\n The Owner reserves the right to transfer, assign, dispose of by novation or subcontract all or any of the rights or obligations arising from the Terms, provided that the User's rights under these Terms are not affected.<\/p>\n You may not assign or transfer in any way your rights or obligations under the Terms without the written permission of the Owner.<\/p>\n All communications relating to Cacciatore d'uve must be sent using the contact information listed in the Agreement.<\/p>\n If any provision of the Terms is held to be void, invalid or unenforceable, that provision will be deleted and the remaining provisions will not be affected and will remain in full force and effect.<\/p>\n These Terms and any disputes concerning the execution, interpretation and validity of this contract are subject to the law, jurisdiction of the State and to the exclusive jurisdiction of the court of the place where the Owner has its registered office.<\/p>\n The exclusive jurisdiction of the consumer is an exception, if the law so provides.<\/p>\n Consumers residing in Europe should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve, out of court, any dispute relating to and\/or arising from online sales contracts for goods and services. Consequently, if you are a European consumer, you can use this platform to resolve any dispute arising from the online contract entered into with the Owner.
